Official Rules
1. HOW TO ENTER
1.(a) No Purchase Necessary
No purchase or payment necessary to enter or win. Purchase will not
improve a participant's chance of winning.
The earthsown™Almond Fresh™Summer Freedom Contest (the "Contest")
commences at 12:01 (PST) July 7, 2010 (the "Commencement Time")
and closes at 11:59 p.m. (PST) September 8, 2010 (the "Expiry Time")
(the period between the Commencement Time and the Expiry Time is the "Contest
Period").
1.(b) Entry
To enter the Contest, visit the Contest web site located at
www.almond-fresh.com (the "Website") and enter your name, email
address, telephone number, a password and your answer to the
mathematical skill-testing question (multiply 11 x 10, add 178, divide
by 8, subtract 6) on the entry form ("Entry Profile"). Upon
submitting a fully completed Entry Profile, a participant is deemed to
be an entrant in the Contest (an "Entrant"). Participation is
limited to one (1) entry per person, per household address during the
Contest Period. All entries must be received by the Expiry Time.
1.(c) Additional Entries
To receive up to ten (10) additional opportunities to enter, Entrants
may submit a "get fresh video" (details of which are on the
Website). All entries and video submissions must be received by no later
than the Expiry Time.
To receive up to three (3) additional opportunities to enter, Entrants
may refer up to three (3) friends to enter. Each friend will receive an
email invitation to enter the Contest. For each friend referred, an
extra entry will be added to an Entrant's Entry Profile. All entries
must be received by no later than the Expiry Time.
Each Entrant is limited to a maximum of fourteen (14) entries (including
an initial entry in accordance with Rule 1(b)).
1.(d) Entry Management
Website tracking software determines the date and time of each entry.
Vivo Health Food Company Ltd. (the "Sponsor"), is not responsible
for any entries lost or misplaced nor for any technical, hardware or
software malfunctions, lost, delayed or corrupted data transmission,
line failures of any network or telephone, or inability to access the
Website.
2. PRIZES
2.(a) Grand Prize
One (1) grand prize will be awarded (the "Grand Prize"). The
Grand Prize will consist of two (2) Cruiser bikes, and four (4) coupon
vouchers, each redeemable for a complimentary carton of
earthsown™Almond Fresh™. The coupon vouchers for
earthsown™Almond Fresh™may be redeemed at any participating
retailer. The approximate retail value of the Grand Prize is $1,220
(CDN).
In order to redeem the Grand Prize, the winner must have reached the age
of majority in the Province or Territory in which they reside. If the
grand prize winner is unable to accept the Grand Prize, the Grand Prize,
will be foregone without compensation.
Secondary Prizes
Four (4) second prizes (collectively the "Secondary Prizes") will
be awarded. The Secondary Prizes will each consist of one of either a
digital camera with video capability (2 being awarded) or iPodsTM with
$50 iTunesTM ("iPod" and "iTunes" are registered
trade-marks of Apple Inc.) gift cards (2 being awarded) and four (4)
coupon vouchers for each secondary winner, each redeemable for a
complimentary carton of earthsown™Almond Fresh™. The coupon
vouchers for earthsown™Almond Fresh™may be redeemed at any
participating retailer. The approximate retail value of each Secondary
Prize is $200 (CDN). The Sponsor will have the sole discretion on the
composition of the Secondary Prizes (being the award of either the
digital camera or the iPod) awarded to each winner thereof.
2.(b) General
Only one winner per prize. Before accepting and receiving the Grand
Prize or a Secondary Prize, all winners must sign a "Declaration of
Compliance with Contest Rules" and a "Liability and Publicity
Release" (the "Documents"), releasing the Sponsor, its
shareholders, subsidiaries and affiliates, and each of their respective
officers, directors, owners, partners, employees, agents,
representatives, successors and assigns, the Contest Administrator, any
distributor or company involved in the supply of a Secondary Prize or
the Grand Prize, or any component or any phase of contest
administration, their respective directors, officers, employees and
their agents or representatives and any person with whom they are
domiciled, from any liability, damages, losses or injury in connection
with the Contest and/or the Secondary Prizes and/or the Grand Prize in
order to be declared a winner. Failure to provide such documentation
will forfeit the prize.
3. DRAW
3.(a) General
Five (5) winners, comprised of one winner of the Grand Prize and four
winners of Secondary Prizes, will be selected from all valid entries
received by the Expiry Date in a random computer generated draw to be
held by Tilwood Direct Marketing, Richmond Hill, an independent judging
organization, on Wednesday, September 15, 2010, at 9:00 a.m. (PST) (the
"Draw"). The odds of winning the Secondary Prizes and the Grand
Prize depend upon the total number of entries received. Arrangements for
redemption of the Grand Prize must be made with the Contest
Administrator prior to December 31, 2010.
All Secondary Prizes and the Grand Prize are non-transferable and must
be accepted as awarded without cash substitutions. Secondary Prizes or
the Grand Prize will be forfeited if not redeemed in accordance with
these Rules. If a Secondary Prize or the Grand Prize is unavailable for
any reason, the Sponsor reserves the right to substitute the Secondary
Prize and/or the Grand Prize, or any component thereof, with items of
equal or greater value. In the event Tilwood Direct Marketing, (the "Contest
Administrator") is unable, due to the unavailability of a winner, to
notify a winner within seven (7) days following the draw, or if a
selected entrant does not sign and return the Documents by the required
return date noted thereon, or if a winner declines a Secondary Prize or
the Grand Prize, the Contest Administrator shall have the right to
disqualify that winner and to draw an alternate winner from all
remaining eligible entries received, and the Contest Administrator and
the Sponsor shall be fully and completely released and discharged from
any and all liability or responsibility in connection therewith.
By entering the Contest, Entrants agree to abide by these Rules.
Entrants represent that permission was received from any referrals to
submit their name/email address for participation in the Contest. The
decisions of the Contest Administrator are final on all matters
regarding the Contest. The skill-testing question must be answered
correctly in order to win a Secondary Prize or the Grand Prize. Provided
that a winner has correctly answered the skill-testing question, he or
she will be notified by mail, telephone, fax or by email within seven
(7) days of the Draw, and the winner will be required to sign the
Documents before accepting the Secondary Prize or the Grand Prize, as
applicable. All winners and any designated travelling companions, as
applicable, will be required to sign the Documents. All Prize winners
will receive her or his Prizes approximately 30 days after receipt of
the executed Documents. No further correspondence will be issued once
the winners have received their respective Secondary Prize or Grand
Prize, as applicable.
4. GENERAL
This Contest is open to Canadian residents (excluding the Province of
Quebec) who have reached the age of majority in their Province or
Territory of residence at the time of entry. This Contest is not open to
directors, officers, employees and contractors of the Sponsor, its
related companies, the Contest Administrator, their agents or
representatives or any distributor or company involved in the supply of
the Secondary Prizes and/or the Grand Prize or any phase of contest
administration, their immediate families and persons with whom they are
domiciled. The Sponsor reserves the right to cancel, terminate, modify
or suspend the Contest, including any method of entry.
Entrants acknowledge that all entries and video files shall become the
property of the Sponsor. By entering this Contest all winners consent to
the use of her or his name, video and photograph to be used for
promotional purposes by the Sponsor without prior notice or additional
compensation.
This Contest is subject to all applicable federal, provincial and
municipal laws, and is owned and operated by Vivo Health Food Company
Ltd., with draws and the contest being administered by Tilwood Direct
Marketing.
